Mayker Consulting Group (referred to as “MCG,” the “Company,” “us,” or “we”), with a website at https://maykerconsulting.co/ (the “Website”), holds as a priority the privacy of our visitors. This Privacy Policy contains details and policies on the types of information that we collect and record, as well as how we use such information. This Privacy Policy applies only to visitors of MCG’s Website and is valid for such visitors with regards to the information that they share and/or collect to or from MCG. This Privacy Policy is not applicable to any information collected offline or via channels other than those connected to the Company’s Website. By using MCG’s Website, you hereby consent to our Privacy Policy and agree to its terms. As agreement to the Company’s Privacy Policy is a fundamental condition of the Company’s Terms of Service Agreement, any client of the Company who agrees to the Company’s Terms of Service has thereby warrantied to the Company that such client has read and consents to this Privacy Policy. Without limitation to the foregoing, anyone who utilizes the Website has a responsibility to read this Privacy Policy and ensure agreement thereto in order to continue such person’s continued use of the Website.

2. Information We Collect

The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information. Personal information may be collected by the Company directly through the Website or connected means.

If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide. By contacting the Company in such manner, you consent to the sharing of such information with the Company.

When a client registers or signs up for the Company’s services via the Website, we may ask for contact information, including items such as the client’s name, a company name, address, email address, and telephone number.

3. How & Why We Use Your information

We may process your personal information for the following purposes (the “Purposes”): 

1. to verify and authenticate your identity;
2. to connect with us through social media, and;
3. to allow us to use the services of third party services.

The Company uses the information we collect in various ways, including to:

4. Log Files

MCG follows a standard industry procedure of using log files. These files log visitors when they visit websites, such as MCG’s Website. Hosting companies generally do this as a part of a hosting services’ analytics. The information collected by log files include:

1. internet protocol (IP) addresses;
2. browser type;
3. Internet Service Provider (ISP);
4. date and time stamp;
5. referring/exit pages, and;
6. the number of clicks.

These series or sets of information are not linked to any personally identifiable information. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering broad demographic information.

Third-party advertising servers or advertising networks uses technologies like cookies, JavaScript, or Web Beacons that are used in the respective advertisements and links that may appear on the Website or in connection to MCG; such technologies are sent directly to the users’ browser. These technologies are used to measure the effectiveness of advertising campaigns and/or to personalize the advertising content that you see on websites that you visit.

Note that MCG has no access to or control over these cookies that are used by third-party advertisers, and that by using the Website, you understand and consent to these technologies being applied to you.

Our services may contain links to other apps, websites or internet resources which are provided solely for your convenience and information. When you click on one of those links, you are contacting another Internet resource. We have no responsibility or liability for, or control over, those other internet resources or their collection, use and disclosure of your personal information. 

MCG’s Privacy Policy does not apply to other advertisers, affiliates, websites, or services. The Privacy Policy also does not cover information a client of MCG may submit to MCG in the broader context of MCG’s service offerings, including any information submitted through a Third-Party Provider of the Company who assists or enables some or all of the functionality or information management of the Company’s service offerings. Thus, the Company is advising you to consult the respective privacy policies of these third-party ad servers, Third-Party Sites, or Third-Party Providers for more detailed information. Such policies may include their practices and instructions concerning opt-out options of certain information collection.

7. Legal Privacy & Data Protection Rights

Applicable privacy laws allow, to varying degrees, individuals the right to access and/or request the correction of errors or omissions in his or her personal information that is in our custody or under our control. You may request access to review your personal information in our possession. However, access may be declined where permitted or required by applicable law. You may also request that we change or delete your personal information in our possession, which MCG will comply with all applicable laws in determining our response to. 

MCG would like to make sure that you are fully aware of all of your data protection rights. Every user is entitled to request copies of your personal data – however we may charge you a small fee for this service. Users have the right to request that we restrict the processing of your personal data, which MCG will do if required or allowed by law and in MCG’s discretion. You also have the right to object to the Company processing your personal data, and to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.

1. 1. Under the California Consumer Protection Act, among other rights, California consumers have the right to:
      1. Request that a business that collects a consumer’s personal data disclose the categories and specific pieces of personal data that a business has collected about consumers.
      2. Request that a business delete any personal data about the consumer that a business has collected.
      3. Request that a business that sells a consumer’s personal data, not sell the consumer’s personal data.

   2. MCG is committed to compliance with Canada’s Anti-Spam Legislation (“CASL”). Any electronic communication we send to outside parties is protected by a range of business procedures, processes and policies to ensure that such communication is done in compliance with CASL. In our electronic communications with outside parties, we comply with the rules established by CASL and enforced by various Canadian authorities, including the Canadian Radio-television and Telecommunications Commission. CASL regulates, and our policies generally apply to, each commercial electronic message (“CEM”) that we send. A CEM is an electronic message sent to an electronic address that, among its purposes, encourages participation in a commercial activity.  In addition to adopting and updating this Policy, we undertake various transparency initiatives to ensure we comply with CASL, which include:
      1. Consent — We do not send you CEMs without your consent. This consent typically must be “express” (expressly acknowledged by you), but in certain circumstances can be “implied” or specifically exempt from consent requirements. We modified or adopted our sign-up, registration and consent forms in order to ensure that your consent is meaningful (i.e. informed and freely given) as per CASL.
      2. Content — We adopted processes to ensure that our CEMs contain the following requirements prescribed under CASL, which may or may not be in the footer of the CEM. We will:
         1. identify ourselves as the party sending the CEM, and whether we are sending the message on our own behalf or on behalf of someone else;
         2. provide you with our contact information; and
         3. set out a clear, working unsubscribe mechanism or preference center that is easy to use, automatic, and at no cost to you (other than your own cost of connecting to the Internet).
      3. Clarity — We ensured that each aspect of a CEM, including its header, content, or any links or URLs in the CEM) conveys the appropriate information, whether viewed individually or taken as a whole, so that you always know what you are clicking on.

If you receive a CEM from us but believe that you should not have or no longer wish to receive CEMs, we will aim to respect your preferences in a timely manner once you update them through our unsubscribe mechanism. 8. Is Your Personal Information Shared or Disclosed?

Your personal information may be accessed by or disclosed to employees of MCG who have a need to know such information. Such employees may include marketing staff, managers, legal advisors, and subject matter experts who are knowledgeable on matters related to an enquiry.

We may disclose your personal information in the following ways:

      • to our business partners;
      • to our service providers including but not limited to online hosting providers, advertising agencies, payment processors and customer service agencies; and

Your personal information that we collect may be processed outside of Canada. As a result, your personal information may be accessible to law enforcement and regulatory authorities in accordance with other jurisdictions’ applicable laws.

We generally keep personal information for only as long as it is needed to accomplish the purposes for which it was collected, unless we are permitted by law to retain the information longer for a legal or business purpose.

10. Children’s Information

Another part of the Company’s priority is adding protection for children while using the internet. We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity. MCG does not knowingly collect any Personal Identifiable Information from children under the age of 13. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

12. Changes to this Privacy Policy

This Privacy Policy was last updated in July 2023. We will occasionally update this Privacy Policy and revise the “last updated” date appearing in this paragraph. 

We will generally notify individuals with whom we have a relationship of material changes to this Privacy Policy, which involve new or revised uses or disclosure of their personal information that may not be reasonably expected by them at the time that they provide personal information to us.  However, we encourage you to review this Privacy Policy from time-to-time, in order to check for updates and refresh your understanding of our personal information handling policies and practices. This Privacy Policy is an essential element of our Terms of Service Agreement, and as such all clients must consent to the provisions of this Privacy Policy in order to agree with MCG’s Terms of Service. Please note that certified agreement with our Terms of Service agreement warranties to the Company that you have read, understand, and consent to the terms of this Privacy Policy.
